This Privacy Policy explains how Quarterpath at Tutter’s Pond (“Quarterpath,” “Community,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you visit our websites, request information, tour our homes, communicate with us via SMS text messaging, email, phone, or in person, or otherwise engage with our marketing and sales activities. It is designed to satisfy U.S. federal and applicable state privacy disclosure standards and to meet wireless carrier requirements for A2P/10DLC messaging programs. Please read it carefully.
1. Scope of This Policy
This Privacy Policy applies to:
- Our primary community website at https://kirboratquarterpath.com/
- Any future live production domain or subdomain branded for Quarterpath at Tutter’s Pond (collectively, the “Sites”).
- Online lead forms, “Request a Tour,” “Download Brochure,” “Contact Sales,” or similar inquiry tools.
- Email, SMS text messaging (including A2P/10DLC campaigns), click-to-call, and call tracking systems used by the Quarterpath sales team, Kirbor Homes, our marketing agency partners, and approved lender or title affiliates.
- Offline collection at model homes, events, pop-up kiosks, open houses, and in-person visitor registration tablets.
This Policy does not cover third-party websites you access via outbound links (for example, lender portals, mortgage application systems, Matterport virtual tour domains, social media platforms, or Realtor listing sites). Those sites are governed by their own privacy statements.
2. Information We Collect
We collect information in three primary ways: (1) you provide it; (2) we automatically collect it; and (3) we receive it from third parties.
2.1 Information You Provide Directly
When you interact with us, you may provide:
- Contact Info: name, email address, phone number(s), mailing address, preferred contact method.
- Household Details: household size, number of bedrooms/baths desired, home features of interest, pets, multigenerational needs.
- Buying Status & Timing: are you renting, already own a home, relocation timing, target move-in date, budget range.
- Tour Preferences: requested appointment dates, virtual vs. in-person, accessibility needs.
- Financing Interest: request to be connected with a preferred lender, down payment estimates, loan type interest (FHA, VA, Conventional, etc.).
- Communication Consents: opt-ins for SMS, email marketing, phone calls, and event invitations.
- Survey Responses & Live Chat messages.
- Contest / Promotion Entries (if applicable).
2.2 Information We Collect Automatically
When you visit our Sites or open our emails we (and vendors working on our behalf) may automatically collect:

- Financing Assistance (At Your Request). Introduce you to approved lender partners, help you compare payment scenarios, and track loan progress if you authorize sharing.
- Marketing Communications. Send educational content, community news, incentives, and promotions via email or SMS (with required consent).
- Improve Our Sites & Campaigns. Analyze traffic, measure ad performance, test creative, and optimize user experience.
- Compliance & Recordkeeping. Maintain proof of communication consent (required for SMS and email marketing compliance), manage opt-outs, and fulfill legal obligations.

- Replying YES to an SMS opt-in confirmation message (when double opt-in is used).
By opting in, you consent to receive autodialed and/or prerecorded marketing, informational, and transactional text messages from Quarterpath at the mobile number you provided. Consent is not a condition of purchase.
4.2 Message Frequency
Message frequency varies. You can expect:
- Up to 4 marketing / update texts per month during general nurture.
- Additional appointment reminders or urgent construction/incentive alerts as needed.
4.3 Cost
Message and data rates may apply depending on your mobile plan.
4.4 How to Opt Out
Text STOP at any time to the number from which you are receiving Quarterpath messages. You will receive one final message confirming your opt-out. You may also request removal by emailing privacy@quarterpathhomes.com or calling the number in Section 18.

4.6 Data Sharing & 10DLC Requirement Statement
Mobile information (phone number, SMS consent data, message metadata) will not be shared with third parties for their own marketing or promotional purposes. Mobile information may be shared with service providers (SMS platforms, CRM, carriers) solely to enable our text program.
4.7 Eligibility
Must be 18 or older or have the consent of a parent/guardian. U.S. numbers only.
5. Email Communications & Your Choices
If you provide your email address, we may send community updates, inventory spotlights, event invitations, financing education, and promotional incentives. We comply with the CAN-SPAM Act.
Unsubscribe: Click the link at the bottom of any marketing email or email unsubscribe@quarterpathhomes.com. Transactional emails related to scheduled tours, contracts, or required disclosures may still be sent where permitted by law.

9. Financing & Lender Referrals
If you ask us to connect you with a preferred or affiliated lender:
- We will share only the information necessary to make the introduction (name, contact info, property interest, estimated budget, and timeline).
- The lender will contact you directly and provide its own privacy disclosures. Your mortgage application, credit report, and financial data are collected and processed by the lender—not by Quarterpath—unless explicitly returned to us with your authorization.
- We may receive high-level status updates (for example, “application started,” “pre-approved,” or “closed”) for sales pipeline reporting.
10. Data Retention
We retain personal information for the shorter of:
- The period needed to fulfill the purposes described in this Policy.
- The time required by applicable law (recordkeeping, tax, warranty obligations).
- Until you request deletion (subject to legal exceptions).
Typical retention guidelines:
- Marketing leads with no engagement: review for deletion or anonymization after 24 months.
- Active buyers / contract records: retain for length of build + 7 years (warranty / legal).
- SMS consent logs: retain at least 4 years from last message for compliance evidence.
11. Your Privacy Rights

11.3 California Residents (CCPA/CPRA)
California residents have additional rights regarding sensitive personal information and certain data-sharing activities. If applicable, we will supply California-specific disclosures upon request.
12. Do Not Sell or Share / Targeted Advertising Opt-Outs
Quarterpath does not sell personal information for money. We do, however, engage in digital advertising that may be considered a “sale” or “share” under some state privacy laws when third-party ad partners use cookies or similar tracking to show you relevant ads across sites.
To Opt Out:

- Enable the Global Privacy Control (GPC) signal in your browser; we will treat a recognized GPC signal as a request to opt out of targeted advertising where legally required.

13. Children’s Privacy
Our Sites and services are intended for adults engaged in new-home research and purchase decisions. We do not knowingly collect personal information from children under 13 years of age. If you believe we have information from a child under 13, please contact us and we will delete it as required by law.

We use a combination of administrative, technical, and physical safeguards appropriate to the sensitivity of the information we collect, including:

No system is 100% secure. Please use caution when sending information by email or SMS and do not transmit sensitive financial data unless requested by a secure lender portal.
15. International Users
Our Sites are operated in the United States and intended for U.S. home shoppers. If you access the Sites from outside the U.S., be aware your information will be transferred to, stored, and processed in the United States where data protection laws may differ from those in your country.
16. Do Not Track & Global Privacy Control
Certain browsers offer “Do Not Track” (DNT) signals. At this time, we do not respond to browser-based DNT signals because no industry consensus exists. We do honor browser-enabled Global Privacy Control (GPC) signals as opt-out requests for targeted advertising where required by law. See Section 12.
17. Changes to This Privacy Policy
We may update this Policy from time to time to reflect changes in law, technology, our practices, or our community offerings. When we make material changes, we will:

Continued use of the Sites after the effective date of an updated Policy constitutes acceptance of the changes.

We sometimes capture photos or video at community events. Attendance may imply consent to appear in marketing materials unless you notify staff you prefer not to be filmed.
